DMCA & Copyright Policy

1. Overview

Altered Stories respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to notices of alleged copyright infringement.

3. Filing a Copyright Infringement Notice

If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  1. Physical or electronic signature of the copyright owner or authorized representative
  2. Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works are involved)
  3. Identification of the infringing material with sufficient detail to locate it (URLs, product IDs, or screenshots)
  4. Your contact information (name, address, phone number, email address)
  5. A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

4. Response to Notices

Upon receiving a valid DMCA notice, we will:

  • Expeditiously remove or disable access to the allegedly infringing content
  • Notify the user who posted the content
  • Provide information about filing a counter-notice if applicable

We aim to process valid takedown requests within 24-48 hours of receipt.

5. Counter-Notice Procedure

If you believe your content was removed in error or due to misidentification, you may file a counter-notice. Your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  4. Your name, address, and phone number
  5. Consent to the jurisdiction of the federal court in your district (or Colorado if outside the U.S.)
  6. Agreement to accept service of process from the original complainant

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

6. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy of terminating accounts of users who are repeat infringers in appropriate circumstances. Users who receive multiple valid DMCA notices may have their accounts terminated.

Filing false DMCA notices or counter-notices may result in legal liability. Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing may be liable for damages.

7. AI-Generated Content

Please note that designs created using our AI tools may not be eligible for copyright protection under current U.S. law. However, this does not affect claims related to:

  • Reference images that may have been used as input
  • Trademarks that may appear in generated designs
  • Other intellectual property rights beyond copyright

We will review all claims on a case-by-case basis.
